The law does not regulate the division of tasks in marriage, so spouses must agree among themselves who is responsible for childcare, housekeeping, and income, and to what extent. This can become a point of contention in the event of separation; many marital problems arise over money and the question of who earns it. These disputes can escalate. Before the separation In the event of a separation, whether with or without court proceedings, there are many things to be settled, such as who will remain in the marital home, where will the children live, what will the visitation rights be, and what maintenance payments will the children and spouse receive? The obligation to cooperate harmoniously in the care of the children and the mutual obligation to support each other remain in place. In dispute Anyone who does not want to divorce can insist on a separation period of up to two years. After that, the other party can no longer oppose the divorce. After the divorce As long as post-marital maintenance is still payable and/or the former spouses have joint dependent children, certain legal obligations remain in place despite the divorce: alimony must be paid on time and all parties involved are entitled to compliance with the care arrangements specified in the judgment. But what if visitation rights do not work out, if the payment of alimony is difficult due to career changes or is not made or not made in full for other reasons? We support you in enforcing your rights and claims in a targeted and sensible manner. Becoming parents The legal system distinguishes between biological and legal parenthood. Within certain limits, children may make their own decisions and even enter into contracts. If parents are unable to do so, the authorities must take the necessary steps. Anyone who is deprived of parental custody loses all parental rights, including the right to make important decisions about their child's upbringing, such as schooling or career choices. The child's guardian then also assumes the authority to represent the child and manage their assets. We are well versed in child protection law and would be happy to advise you. We also represent your interests vis-à-vis the competent authorities and assist you in lodging appeals. Cohabitation is often chosen as a form of living together in order to avoid the rigid rules of permanent marriage and to be free. The legislator does not provide non-marital partnerships with legal instruments appropriate to their situation. There is no social and financial network for the benefit of the other partner. A sense of responsibility towards your partner requires individual, written estate and pension planning. We can provide you with expert support in this area. Rights and obligations Unlike marriage, cohabitation is not regulated by law. However, you can still make your own arrangements to represent your partner in legal matters or ensure that you are allowed to visit them in hospital or receive information from doctors. You can – and should – set out provisions for both living together and a possible separation in a cohabitation agreement. And in a will or inheritance contract, you can also name your partner as a beneficiary under inheritance law and clarify BVG benefits. If made in good time, these written agreements help to avoid unnecessary hassle and costly disappointments. Unfortunately, this is not a trivial matter. We would be happy to help you overcome this hurdle. Relationship with former spouses Cohabitation can have an impact on maintenance payments for a separated or divorced spouse. A so-called cohabitation clause is often included in the divorce decree. We advise you on the consequences and what applies if there is no cohabitation clause. Joint children If a cohabiting couple is expecting a child, the child is not disadvantaged by this. However, the legal status of the mother and father is different from that of married couples. Upon the birth of the child, the mother automatically has sole custody. If you as parents wish to exercise joint custody, you must submit a joint declaration. We strongly recommend that you make such written agreements as a precaution at the time of the child's birth – they help to avoid unnecessary trouble and costly disappointments, as well as later discussions about visitation rights and child support. Non-joint children If your partner brings their own children into the relationship, you form a so-called patchwork family, which deviates from the classic father-mother-child model. The new partner does not have the task of replacing the father or mother. Previous child support payments are not eliminated by cohabitation. However, after a few years, the new partner may become liable for child support or adoption may become an option. This gives them a legal status similar to that of married couples. If a homosexual couple lives together without this registration, essentially the same applies as for heterosexual partnerships.
