I. EXECUTION AND PERFORMANCE
1. We are committed to professional, careful, material-friendly, and environmentally conscious textile care.
2. The methods and practices customary in the industry are defined in the definitions (information sheet on practices) published by the Swiss Textile Care Association.
3. The textile care provider may charge surcharges on the prices set in the price list for special items (risky items, expensive and/or material-intensive items, etc.).
4. The number of items or quantities counted by the textile care company are decisive for delivery, return, and billing.
5. Separate provisions apply to leased and rented laundry.
II. RESPONSIBILITY
1. The textile care provider shall only be liable if the items are durable when treated in accordance with the procedure recommended on the textile care label. If there is no textile care label, the textile care provider shall rely on its expertise and the intended use of the item; liability shall be expressly rejected if there is no textile care label.
2. Despite prior professional inspection of the goods, we cannot accept any responsibility for damage caused by unrecognizable characteristics or hidden defects, such as insufficient strength of the material or seams, authenticity of dyes and prints, effects on buttons, buckles, zippers, underarm pads, appliqués, ornaments, ribbons, etc., or due to incorrect textile care labels. Liability for changes in the dimensions or color of fabrics and knits within the usual tolerance range is excluded.
3. The need for special treatment must be obvious, in particular due to detectable sensitive properties or soiling that requires special treatment. The care symbols and/or care instructions on the textile care label are decisive for the textile care provider.
4. The textile cleaner may accept the care order with reservations (so-called reservation declaration).
5. The care order is established as an order within the meaning of OR 394 ff. A guarantee of success is excluded.
III. RETURN
1. We endeavor to meet the agreed delivery dates. However, delays do not entitle the customer to claims for damages.
2. The item will only be released upon cash payment and return of the order confirmation. For major customers, invoicing will be carried out in accordance with a separate agreement.
3. Items must be collected within six months of placing the order. If collection does not take place within this period, the textile cleaner may dispose of them without replacement. In the case of more valuable items, the textile cleaner will send a reminder to the customer in advance, provided that the name and address of the customer are known. The textile cleaner is under no obligation to make any inquiries in this regard.
4. If an order cannot be fulfilled, the item will be returned in its current condition.
IV. COMPLAINTS
1. Complaints must be made immediately upon receipt of the item, at the latest within three working days, and must be accompanied by the receipt.
2. Complaints will be carefully examined by the textile care provider, answered or explained with reasons, and the further course of action (appropriate follow-up treatment, referral for assessment and arbitration to the Joint Claims Settlement Board, etc.) will be determined in agreement with the customer wherever possible.
3. Claims cannot be insured in the textile care sector in Switzerland. In the event of damage to the item or loss through the fault of the textile care provider, compensation will be paid in accordance with the current value table for the depreciation of textile care items. Actual replacement is excluded.
4. If no agreement can be reached, we recommend that the parties submit the claim to the Joint Claims Settlement Office of the consumer protection organizations of the Swiss Textile Care Association (VTS) and the Swiss Fashion Stores (SFS) for assessment and arbitration.
V. PLACE OF JURISDICTION
1. The place of jurisdiction for any disputes arising from the care order is the registered office of the textile care provider.
