Advocacy
Litigation
Lawyers represent their clients in proceedings before courts and authorities.
The procedural representation of clients before cantonal and federal civil and criminal courts as well as before administrative judicial authorities is reserved for lawyers who are registered in a canton's register of lawyers.
Attorneys who are registered in a cantonal register of attorneys may represent parties in court proceedings throughout Switzerland without further authorization.
Advisory services
In addition to representing clients in court, lawyers advise and represent their clients in all legal matters and draft contracts and other legal documents.
Where possible, lawyers seek ways to protect their clients' interests without resorting to litigation. They inform them of their rights and the legal means of enforcing them. If a conflict with an opposing party already exists, they attempt to reach an out-of-court settlement through discussions. If this is not or no longer possible, lawyers represent their clients before courts and authorities.
Independence, professional secrecy, and supervision
Lawyers practice their profession independently, in their own name and on their own responsibility.
Lawyers are bound by professional secrecy for an unlimited period of time and towards everyone with regard to everything that has been entrusted to them by their clients as a result of their profession. They ensure that their assistants also maintain professional secrecy.
In the exercise of their profession, lawyers are subject to supervision by the cantonal bar supervisory authority.
Notary
Necessity of public certification
The Swiss Civil Code (ZGB) requires public notarization for various legal transactions, such as real estate purchase agreements.
In a public document, a legally relevant fact, a legal transaction or a procedural declaration is recorded in writing by the notary in a specific form and according to a specific procedure. The notary is obliged to record the will of the parties clearly and unambiguously in the document, to advise the parties and to inform them of the consequences of their actions.
